Right to access information

Introduction

The Međimurje Museum in Čakovec (hereinafter referred to as “the Museum”) is a public institution whose programmes and actions have been set out as public interest by the law. They are wholly or partially funded by the state budget or the budget of the local and regional self-government. The Museum informs the public about its organisation and work programmes as well as the affairs falling within its museum and gallery activities by providing information through public media. Apart from the above, pursuant to the provisions of the Act on the Right to Access Information includes the right of any domestic or foreign natural person or legal entity to request and obtain information as well as the obligation of the Museum to grant the user the right to access the requested information. The Međimurje Museum in Čakovec has to routinely publish information even in the absence of a particular request – such publishing represents an obligation set out by the law or other general regulation for the purpose of informing the public in a timely and accurate manner. Information is a written, drawn, image, printed, recorded, magnetic, optical, electronic or other record of data on any individual subject matter that constitutes a substantial whole which is owned, created, handled or overseen by the Museum. The Međimurje Museum in Čakovec has the status of a public institution that performs museum activities as a public service.

The activity of the Međimurje Museum in Čakovec is of special interest not only for the narrow, but also wider regional area. It is realised by means of museum, gallery, printing, library and publishing programmes.

Within the scope of its business activities, the Međimurje Museum in Čakovec performs the following:

systematic collection, keeping and researching of civilisation and cultural goods as well as their professional and scientific handling; systematisation in collections of items from the history of the County, cultural and economic history, science and technology

protection of the museum materials and documentation

preparation and organisation of permanent and periodical exhibitions

publishing of catalogues, monographs and books

publishing of information about the museum materials and documentation

Exercising the right to access information

The Museum informs the public about the time and manner of the performance of its museum and gallery activities by publishing the information on its website and in public media in a timely and accurate manner.

Apart from the above, users can exercise their right to access information by submitting an oral or written request to the Museum – i.e., the information officer – in accordance with the provisions of the Act on the Right to Access Information. The request form is available on the Museum website. A written request can be submitted by regular mail, e-mail or telefax. If the request was submitted orally, an official statement thereof shall be drafted. If it was submitted by telephone or another communication device, an official record thereof shall be drafted.

The applicant need not state the reasons for the access to information, but may suggest the manner of obtaining the information.

The museum will provide information to users who submitted their requests:

  • by providing the information directly
  • by providing the information in writing
  • by enabling access to document or by creating copies of documents that contain the requested information
  • by delivering copies of documents that contain the requested information
  • in any other manner appropriate for exercising the right to access information.

The Museum reserves the right to deny access to information in the cases set out in the provisions of the Act on the Right to Access Information.

Deadlines pertaining to the right to access information

On the basis of an oral or written request, the Museum will enable the applicant to access information no more than 15 days from the day of the submission of the request. In case of an incomplete or vague, the Museum will invite the applicant to correct it within three days. If the applicant fails to do so, the Museum will reject the request as vague or incomplete by means of a decision. If the Museum does not possess, handle or oversee the requested information, but knows which competent authority possesses, handles and oversees the information, it shall forward the request to the authority concerned without delay and no more than eight days from the receipt of the request, and will notify the applicant thereof. In such a case, the time limit to exercise the right to access information shall start on the day on which the public authority receives the forwarded request. If the Museum does not possess, handle or oversee the requested information and has no knowledge of where the information can be obtained, it will reject the request to access the information.

The time limits for exercising the right to access information may be extended by 30 days:

  • if the information must be requested outside the headquarters of the public authority
  • if one request includes a greater amount of different information
  • if it is necessary in order to ensure the completeness and accuracy of the requested information

The Museum shall notify the applicant without delay and within no more than eight days of the extension of the time limit, including the reasons thereof.

The Personal Data Protection Agency as an independent authority for the protection of the right to access information shall be competent for any appeals to decisions adopted by the Museum. Decisions adopted by the Personal Data Protection Agency may be contested before the Administrative Court of the Republic of Croatia.
